Terms of Service

Welcome to CastBack! CastBack LLC operates an online marketplace where fly anglers can buy and sell fly fishing gear. These Terms of Service explain the rules for using our platform and help ensure a safe, fair, and enjoyable experience for everyone. By creating an account or using CastBack, you agree to these Terms.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use CastBack. By using the Service, you represent that you meet this requirement and can form a binding contract.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. Marketplace Integrity
Users may not manipulate marketplace activity, including but not limited to creating fake accounts, submitting fraudulent reviews, artificially inflating prices, shill bidding, or otherwise interfering with the fair operation of the marketplace. Any attempt to manipulate CastBack or its users may result in immediate account suspension or termination.
4. Community Standards
CastBack is built around a community of anglers who share a passion for fly fishing. We expect all users to treat one another with courtesy and respect. Harassment, threats, discrimination, abusive language, fraud, or any behavior intended to intimidate or deceive another user is prohibited. We reserve the right to remove content, suspend accounts, or terminate access to the Service for violations of these standards.
5. Listings and Sales
Sellers are responsible for creating accurate listings, including clear photos, truthful descriptions, item condition, pricing, shipping costs, and any known defects. Buyers are responsible for reviewing listings carefully and asking questions before purchasing or submitting an offer.
6. Listing Accuracy
Listings must accurately represent the item being offered. Sellers are expected to provide truthful descriptions, clear photographs, and disclose any known defects, repairs, modifications, or significant wear. Deliberately misleading listings may be removed, and repeated violations may result in account suspension.
7. Prohibited Items
CastBack reserves the right to prohibit certain items from being listed on the platform. This includes, but is not limited to, counterfeit goods, stolen property, illegal products, hazardous materials, recalled items, and any item whose sale would violate applicable law. We may remove prohibited listings without notice.
8. Authenticity and Ownership
Sellers represent that they own, or have the legal right to sell, every item they list on CastBack. Counterfeit, replica, stolen, or otherwise unlawful items are strictly prohibited. CastBack reserves the right to remove any listing or suspend any account suspected of violating this policy.
9. Item Condition
CastBack specializes in previously owned equipment. Normal signs of use should be expected unless otherwise stated. Sellers are expected to disclose significant defects or damage. Buyers are encouraged to review photos carefully and request additional information before purchasing.
10. Fraud and Misrepresentation
Users may not intentionally misrepresent the condition, authenticity, ownership, or availability of any item. Knowingly providing false information, using deceptive photographs, or engaging in fraudulent activity may result in immediate account suspension or termination and may be reported to the appropriate authorities.
11. Offers and Orders
Submitting a Buy Now request or Offer does not immediately complete a sale. Sellers may accept, decline, or allow requests to expire. If a seller accepts a Buy Now request, the buyer must complete payment within the time allowed by the platform. A transaction is considered complete only after payment has been successfully processed.
12. Off-Platform Transactions
CastBack exists to provide a secure marketplace for buyers and sellers. Users may not use CastBack to arrange, solicit, or encourage transactions outside the platform in order to avoid marketplace fees or protections. This includes sharing contact information or payment details for the purpose of completing a transaction outside CastBack. Accounts found attempting to circumvent the marketplace may have listings removed, transactions canceled, or accounts suspended or terminated at CastBack's sole discretion.
13. Payments
Payments are securely processed through Stripe. CastBack does not store full payment card information. Buyers and sellers are responsible for any applicable taxes, fees, or reporting requirements required by law.
14. Shipping and Delivery
Sellers are responsible for packaging items appropriately, shipping them within the required timeframe, and providing accurate tracking information.
Buyers are responsible for inspecting items promptly upon delivery and reporting concerns through CastBack Messages.
CastBack is not a shipping carrier and is not responsible for loss or damage occurring during shipment. Buyers who would like additional protection should request shipping insurance from the seller before completing payment.
15. Disputes
CastBack may, at its sole discretion, review disputes between buyers and sellers to help facilitate a fair resolution. However, CastBack is not a party to transactions and cannot guarantee the outcome of disputes. Final responsibility for transactions remains with the buyer and seller.
16. Prohibited Conduct
You agree not to use the Service to post unlawful content, harass other users, list prohibited items, attempt to bypass fees, or interfere with the integrity of the platform.
17. Reviews and Content
Reviews and other user-submitted content must be honest and based on actual transactions. We may remove content that violates these Terms.
18. Intellectual Property
CastBack and its content are protected by applicable intellectual property laws. You retain ownership of the photos, descriptions, reviews, and other content you submit to the Service. Users represent that they own, or have the necessary rights to, any content they upload and that granting this license does not infringe upon the rights of any third party. By submitting content to CastBack, you grant CastBack LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting purposes only), publish, display, distribute, and promote that content as reasonably necessary to operate and market the Service. This includes, but is not limited to, displaying listings on the CastBack marketplace, featuring listings on CastBack's website, social media channels, newsletters, emails, advertisements, and other promotional materials. This license continues only for as long as your content is available on the Service, except where retained as required for legal, operational, archival, or backup purposes.
19. Disclaimers
CastBack provides an online marketplace that connects buyers and sellers. Unless explicitly stated otherwise, CastBack does not own, inspect, verify, or guarantee any item listed for sale and is not responsible for the actions, omissions, or representations of buyers or sellers.
20. Limitation of Liability
To the maximum extent permitted by law, CastBack is not liable for any indirect, incidental, or consequential damages arising out of your use of the Service. CastBack shall not be liable for lost packages, shipping delays, carrier damage, inaccurate listings, fraudulent conduct by users, or disputes arising between buyers and sellers.
21. Right to Remove Content
CastBack reserves the right, but is not obligated, to review, edit, remove, refuse, or restrict any listing, message, review, or other user-submitted content for any reason, including content that violates these Terms or is otherwise deemed harmful to the marketplace.
22. Marketplace Enforcement
CastBack reserves the right to investigate suspected violations of these Terms and to remove listings, restrict marketplace features, suspend accounts, terminate accounts, or take other appropriate action at our sole discretion. These decisions are intended to protect the integrity and safety of the CastBack community.
23. Termination
We may suspend or terminate accounts that violate these Terms. You may close your account at any time.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes to our platform, applicable laws, or our business practices. Updated Terms will be posted on this page with a revised Effective Date. Your continued use of CastBack after changes become effective constitutes acceptance of the revised Terms.
25. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any legal action arising out of or relating to these Terms shall be brought in the appropriate state or federal courts located in Michigan, unless otherwise required by applicable law.
